Terms of Use Agreement

This Terms of Use Agreement (“Agreement”) is a legal agreement between you (“User”) and Stand Up Analytics (“Company”) regarding the use of the Stand Up Analytics application (“App”). By accessing or using the App, User agrees to be bound by the terms and conditions of this Agreement.

API Access and Data Transfer
The App utilizes BigTime API keys to access data from BigTime. The resulting data acquired through API access is transferred directly from BigTime to User’s company’s Microsoft tenant. Company does not receive, view, or store User’s data or API credentials at any time. User acknowledges that BigTime’s terms of use and privacy policy apply to their API access and data usage.
Collection and Use of Email Address
User acknowledges that Stand Up Analytics collects the email address entered into the App. This information is used solely for the purpose of verifying license validity and tracking data related to refresh frequency. Company will not share, sell, or rent User’s email address to any third party without User’s consent, except as required by law.
Ownership and Intellectual Property
The App, including but not limited to its design, features, functionality, and content, remains the property of Company and is protected by applicable intellectual property laws. User agrees not to reproduce, modify, distribute, or create derivative works based on the App without prior written consent from Company.
Restrictions on Use
User agrees to use the App solely for lawful purposes and in compliance with all applicable laws, regulations, and third-party rights. User shall not engage in any of the following:
- a) Reverse engineer, decompile, or disassemble the App;
- b) Interfere with or disrupt the functionality of the App;
- c) Use the App to upload, transmit, or distribute any harmful or malicious software or content;
- d) Infringe upon Company’s intellectual property rights or the rights of any third party.
Limitation of Liability
In no event shall Company be liable to User or any third party for any damages, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with the use or inability to use the App or its services, even if Company has been advised of the possibility of such damages.
Indemnification
User agrees to indemnify and hold harmless Company, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, or expenses, arising out of or in connection with User’s use of the App, including any violation of this Agreement.
Modification of Terms
Company reserves the right to modify or amend this Agreement at any time by providing notice to User. It is User’s responsibility to review this Agreement periodically for any updates or changes. Continued use of the App after modifications constitutes acceptance of the revised terms.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Company operates. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
Entire Agreement
This Agreement constitutes the entire agreement between User and Company regarding the use of the App, superseding any prior agreements or understandings. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By using the App, User acknowledges that they have read, understood, and agree to be bound by this Terms of Use Agreement.

Privacy Policy

This Privacy Policy (“Policy”) describes how Stand Up Analytics (“Company,” “we,” “us”) collects, uses, and protects the personal information of users (“User,” “you”) when accessing or using the Stand Up Analytics Power BI Template application (“App”).

Personal Information Collection: When using the App, we may collect personal information, such as your email address. This information is voluntarily provided by you when entering it into the App.

Use of Personal Information: We collect your email address for the purpose of verifying license validity and tracking data related to refresh frequency. We will not sell, share, rent, or disclose your email address to any third party, except as required by law.

Data Security

We take reasonable measures to protect the personal information we collect from unauthorized access, disclosure, alteration, or destruction. However, please note that no method of transmission over the internet or electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security. Keep in mind that we do not collect the User’s BigTime data or API credentials so they are not at risk at any time from security related issues or breaches related to our services.

Third-Party Services

The App may integrate with third-party services or APIs, such as the BigTime API. These services are subject to their own terms of use and privacy policies. We are not responsible for the privacy practices of these third-party services. We encourage you to review their policies before using the App.

Children’s Privacy

The App is not intended for children under the age of 13. We do not knowingly collect personal information from children. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us, and we will delete such information from our records.

Changes to the Privacy Policy

We may update this Privacy Policy from time to time. Any changes will be effective upon posting the updated Policy on our website or within the App. It is your responsibility to review this Policy periodically for any updates or changes. Your continued use of the App after any modifications constitutes acceptance of the revised Policy.
